New Zealand Non-Convention Design Application
Filing Requirements

No deadline to file.

To file the Application we will require:
-
Representations of the design. no limit to the number of view.

No limit to the number of views.​

Photos or Drawings are allowed
-
Full name and address of the Owner.

Name of the designer.
-
Mutiple designs can only be filed for a set of articles otherwise individual design applications are required.

An Authorisation of Agent form is required to be signed by the Applicant.

Examination

The Application is generally examined within 15 days from filing. If objections are raised, an Examination Report will issue.

Deadline – the Office will set a deadline of 12 months the examination report date to overcome any objections. N.B. this is not a response deadline but a registration dedline.

The registration deadline can be easily extended by up to 4 months.
-
A postponement of registration can be made to delay the registration of the design for up to 12 months from the filing date.

Registration

The initial term of registration is 5 years from the filing date. The total registartion term is 10 years.

Deadline to file – 6 months from the filing date of the first filing in a Convention country.

Name of the designer.

The country, design number and filing date of the first filing.

Mutiple designs can only be filed for a set of articles otherwise individual design applications are required.

An Authorisation of Agent form is required to be signed by the Applicant (can be filed later).

A scanned, certified copy of the priority application is required (can be filed later).

A DAS code is NOT able to be used.
